An old topic - Smoking bans?

Hi folks





Anyone tell me what the current regulations are for smoking in bars in Germany ?





I was under teh impression that the German authorities had relaxed teh ban following a successful court action by smaller bar owners.





So how does things stand - is the ban suspended pending further legislation, or is it the case that small bars are exempt for the time being, or is the original legislation being followed.





Four of us are visiting this weekend - two smokers, two non. Seeing people smoke in bars will be bizarre experience !!

First of all, there%26#39;s a difference between different German Laender (states).





In Berlin, small pub owners have indeed appealed, and the court ruled that places that serve no significant food (only alcohol) and are %26quot;one room establishment%26quot; do not have to comply with the law. Most bars are smoking bars.





In restaurants, they are supposed to be either non-smoking, or allocate a separate smoking room. No provisions have been made regarding smoking outdoors, so expect smoking around you when sitting at the tables outside the restaurant/cafe. Most restaurants/cafes do comply though with the indoor policy.

My experience in Berlin was, no smoking inside even in some pub, restaurant is always no smoking.



At tables outside is ok to smoke.





One restaurante had separet areas, I went to a marroquinian restaurant that had this. But this was a big place, maybe thats why they had.

In Hessen it is similar to Berlin, if you are a very small pub owner, less than 75 sq.m. then you can choose to be a smoking or non-smoking establishment. No one under 18 is allowed in and there is a fairly large sign on the door claiming it as a %26quot;Raucher Lokal%26quot; or smoking pub. Larger bars and restaurants may only allow smoking if they have a separate completely closed off room. Outside smoking is allowed everywhere, which can be annoying in the summer.
